Terms & Conditions

Last updated: August 2026. These terms govern all engagements between Talent Select (ETC Consult Ltd) and its clients.

1. About Talent Select

Talent Select is a trading name of ETC Consult Ltd, a company registered in Ireland (Registered Office: 10 Marlborough Court, Dublin 1, D01 EK77). References to "Talent Select", "we", "us", or "our" in these terms refer to ETC Consult Ltd. References to "client" or "you" refer to any individual or organisation that engages Talent Select for assessment services.

2. Nature of the service

Talent Select provides psychometric assessment services to assist clients in evaluating the suitability of candidates for open roles. Our assessments use the Occupational Personality Inventory (OPI) and, where agreed, aptitude instruments to generate scores and reports measuring candidate fit against an ideal profile established in collaboration with the client.

The output of our assessments, including ranked leaderboards, individual candidate profiles, and debrief guidance, represents our professional interpretation of psychometric data as it relates to the specific role profile agreed with the client at the outset of each engagement. These outputs are recommendations and indicators of likely suitability, not statements of fact about any individual's character, capability, or guaranteed future performance.

3. Limitation of liability: hiring outcomes

Talent Select's assessment outputs are based on psychometric instruments that are internationally validated and statistically grounded. However, no assessment tool, however well designed or professionally administered, can guarantee the performance, conduct, retention, or suitability of any individual in any role.

Accordingly:

3.1 The client acknowledges that Talent Select's assessment outputs are one input in the hiring process and should not be used as the sole basis for any hiring decision.

3.2 The final decision to hire, decline, or otherwise act in relation to any candidate rests entirely and solely with the client. Talent Select makes no hiring decisions and has no authority over or involvement in the client's employment process beyond the provision of assessment outputs and advisory debrief.

3.3 Talent Select accepts no liability whatsoever, whether in contract, tort, negligence, or otherwise, for any hiring decision made by a client, including but not limited to: the employment of a candidate who subsequently underperforms, causes loss, or is dismissed; the rejection of a candidate who would have been successful; any employment dispute, claim, or tribunal arising from a client's hiring process; or any direct, indirect, consequential, or incidental loss suffered by the client or any third party as a result of reliance on Talent Select's assessment outputs.

3.4 The scores, rankings, and profiles produced by Talent Select indicate the statistical likelihood of candidate suitability based on the agreed role profile. Likelihood is not certainty. Talent Select does not warrant that any candidate assessed as a strong fit will succeed in the role, nor that any candidate assessed as a weaker fit would not succeed.

4. Client responsibilities

The client agrees to:

4.1 Use Talent Select's assessment outputs as one element of a broader, considered hiring process, alongside interviews, reference checks, and any other due diligence the client considers appropriate.

4.2 Not make any employment decision based solely on Talent Select's assessment output without applying their own independent judgement.

4.3 Ensure that candidates are informed that psychometric assessment forms part of the selection process, and that appropriate consent is obtained prior to assessment in compliance with applicable data protection law.

4.4 Use assessment outputs and candidate data solely for the purposes of the hiring decision for which the assessment was commissioned, and not share, sell, or otherwise disclose candidate data to any third party without the candidate's consent.

5. Accuracy of the role profile

The quality and relevance of Talent Select's assessment output depends on the accuracy and completeness of the information provided by the client during the role profiling stage. Talent Select is not responsible for assessment outcomes that are affected by inaccurate, incomplete, or subsequently changed role requirements provided by the client.

6. Candidate data and data protection

Talent Select processes candidate personal data as a data processor on behalf of the client, who acts as the data controller for the purposes of the General Data Protection Regulation (GDPR) and the Data Protection Acts 1988 to 2018. Talent Select processes candidate data only for the purpose of completing the agreed assessment and will not use candidate data for any other purpose. Candidate data is retained for a period of twelve months following completion of the assessment, after which it is securely deleted unless otherwise agreed in writing. Clients are responsible for ensuring they have a lawful basis for sharing candidate data with Talent Select and for meeting their own GDPR obligations in relation to candidates.

7. Intellectual property

All assessment instruments, methodology, scoring frameworks, report templates, and related intellectual property used in the delivery of Talent Select's services are and remain the property of ETC Consult Ltd or its licensed partners. Assessment outputs produced for a specific engagement are provided to the client for their internal use in connection with that hiring decision only. Clients may not reproduce, distribute, resell, or adapt any Talent Select assessment output or methodology without prior written consent.

8. Payment

Fees are as agreed at the time of engagement, whether for a single-role engagement or a bundle. All fees are exclusive of VAT, which will be charged at the applicable rate. Single-role engagements are invoiced on commencement of the role profiling stage. Bundle credits are invoiced on purchase. Payment terms are thirty days from date of invoice unless otherwise agreed in writing. Bundle credits are valid for eighteen months from date of purchase and are non-refundable after a role profiling session has commenced for that credit.

9. Limitation of total liability

To the fullest extent permitted by applicable law, Talent Select's total aggregate liability to the client under or in connection with any engagement, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total fees paid by the client to Talent Select in respect of the specific engagement to which the claim relates.

10. Governing law

These terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Ireland. The parties irrevocably submit to the exclusive jurisdiction of the Irish courts.

11. Changes to these terms

Talent Select reserves the right to update these terms at any time. The current version will always be available at talentselect.com/terms. Continued use of Talent Select's services following any update constitutes acceptance of the revised terms.
